DuckyTots™ is a brand operated by an individual business owner (the "Jesus Elian Garcia”).
These Terms of Service (“Terms”) govern your access to and use of the DuckyTots™ website, online store, products, content, features, tools, and related services (collectively, the “Services”).
Throughout these Terms, the terms “we,” “us,” and “our” refer to the individual Business Operator conducting business under the DuckyTots™ brand.
Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer and sell products and Services to you.
By visiting our website, placing an order, making a purchase, or otherwise using our Services, you agree to these Terms and to any policies incorporated into them, including our:

Because our products may be used by or around young children, continuous and attentive adult supervision is required at all times.
A child must never be left unattended in or around:
- A bathtub
- Shower
- Bathroom
- Water source
- Any environment presenting a drowning, slipping, or falling risk
DuckyTots™ products are not a substitute for active adult supervision and should never be relied upon as a drowning-prevention, fall-prevention, restraint, or safety device unless expressly certified and marketed for that specific purpose.
Parents, guardians, and caregivers are responsible for ensuring that the product is:
- Properly assembled
- Used on an appropriate surface
- Used in accordance with all instructions
- Inspected before each use
- Used within any applicable age, weight, height, or other limitations
Do not use the product if it appears damaged, cracked, unstable, improperly assembled, excessively worn, defective, or otherwise unsafe.

5. ADULT SUPERVISION
Images, videos, product demonstrations, advertising materials, descriptions, or instructions provided by DuckyTots™ are intended to demonstrate or explain the product.
They do not represent that accidents cannot occur.
No product eliminates the risks associated with children being in or around water.
Parents, guardians, and caregivers remain responsible for active and appropriate supervision.
Nothing in these Terms excludes liability where such liability cannot legally be excluded.
6. ORDERS
Submitting an order constitutes an offer to purchase the selected products.
An automated order confirmation acknowledges that we have received your order but does not necessarily constitute final acceptance where a legitimate issue subsequently prevents fulfillment.
We may cancel or reject an order where reasonably necessary because of:
- Product unavailability
- Payment authorization failure
- Suspected fraud
- Shipping restrictions
- Legal restrictions
- An obvious pricing or listing error
If we cancel an order after payment has been collected, we will refund the amount owed in accordance with applicable law.
You are responsible for providing complete and accurate billing, contact, and shipping information.

We will not use this provision to arbitrarily change the agreed price of a valid transaction.
9. SHIPPING AND DELIVERY

Once shipped, estimated delivery is typically:

depending on the customer's location and carrier.
These delivery periods are estimates unless a guaranteed delivery service is expressly identified as such.

We may use third-party suppliers, fulfillment providers, warehouses, or shipping carriers to fulfill orders.
Use of third-party fulfillment does not eliminate any responsibility that applicable consumer law places on us.
If we become unable to ship an order within an advertised shipment timeframe, we will comply with applicable requirements concerning delay notification, cancellation, and refunds. U.S. federal rules, for example, require sellers to have a reasonable basis for advertised shipping times and to offer cancellation/refund options when qualifying delays occur.
10. THIRD-PARTY FULFILLMENT
Certain orders may be stored, processed, packaged, or shipped with assistance from third-party fulfillment providers or suppliers.
To fulfill your order, necessary information may be provided to such partners, including:

Third-party fulfillment does not change your contractual relationship with the Business Operator selling under the DuckyTots™ brand.
11. 90-DAY SATISFACTION GUARANTEE
Eligible purchases are covered by the DuckyTots™:
90-Day Satisfaction Guarantee
The 90-day period begins on the date the product is delivered.
The requirements and conditions governing this voluntary guarantee are described in our Return & Refund Policy.
The 90-Day Satisfaction Guarantee is a voluntary commercial guarantee provided in addition to statutory consumer rights.
It does not replace, reduce, or limit legal rights relating to defective, unsafe, incorrectly described, or non-conforming products.
12. RETURNS AND REFUNDS
Returns, refunds, exchanges, and cancellations are governed by our Return & Refund Policy.
Depending on applicable law, customers may have additional rights regarding:
- Returns

- Repairs
- Replacements
- Cancellation
- Withdrawal
- Defective products
Any mandatory consumer rights remain unaffected.
13. EUROPEAN UNION CUSTOMERS

The DuckyTots™ 90-Day Satisfaction Guarantee exists in addition to these legal protections.
EU consumers generally receive a minimum two-year legal guarantee for faulty or non-conforming goods, and qualifying distance purchases generally carry a 14-day withdrawal right.
If a provision of these Terms conflicts with mandatory EU or applicable national consumer law, the mandatory law will prevail.
14. UNITED KINGDOM CUSTOMERS
Nothing in these Terms limits mandatory rights available under applicable UK consumer law.
Where applicable, consumers retain legal rights concerning:
- Distance purchases
- Cancellation
- Returns
- Refunds
- Delivery
- Defective goods
- Goods that do not match their description
Mandatory UK consumer rights prevail over conflicting provisions of these Terms.

Where content is submitted specifically for publication or promotional use, you grant the Business Operator a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and adapt that content in connection with operating and promoting DuckyTots™, subject to applicable law.
We will not knowingly fabricate customer testimonials or materially alter authentic reviews in a misleading manner.

Because you currently operate without a separate incorporated entity, these Terms also do not attempt to create a fictional liability shield between the Business Operator and the DuckyTots™ brand.

To the extent permitted by law, users may be responsible for losses reasonably arising from their unlawful misuse of the Services or material violation of these Terms.
This section does not require consumers to indemnify us for losses caused by our own unlawful conduct, negligence, defective products, or circumstances where such an obligation would be prohibited or unfair under applicable law.

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be limited or removed to the extent necessary.
The remaining provisions will remain effective where permitted by law.
